High Risk Component Resolution

The Condominium Property Act allows the board to adopt a “high risk components” resolution (HRS §514B-138). The standard provision in most the condominium documents allow the board to take action to make an owner maintain and repair his apartment after something has happened. The high risk components resolution is intended to allow the board to take action to make an owner maintain and repair his apartment before something happens. Essentially, the provision for high risk components allows proactive action on the part of the board to reduce the risk of damage to other units or the common elements.
