Terminating Utilities And Common Services
This process is established under the law [HRS §514B-146(e) & (f)] and sometimes found in the declaration or bylaws of newer condominium projects. By law, it applies only to owners, not tenants. Before the policy can be put into effect, the board must first adopt a policy on terminating utilities and common services and have the policy approved by a majority of all the owners. In addition, once a policy is in effect, the board must give the owner and the holder of the first mortgage on the owner’s apartment 60 days’ prior notice of the board’s intent to implement the policy.
